National Health Insurance Law: The Right to Health in Israel

The National Health Insurance Law, enacted in 1994, is a cornerstone of Israel’s healthcare system. The law enables every resident of the State of Israel to receive public healthcare services through a health fund.

What are the rights under the law?

The right to the Health Services Basket

The National Health Insurance Law established a “Health Services Basket,” which the health funds are required to provide to every insured person under the national health insurance system. The Health Services Basket includes basic healthcare services, encompassing a wide range of medical services, medications, medical equipment, and more. Some services are provided free of charge, while others require a co-payment.

The right to quality and accessibility

Services must be provided at a reasonable quality, within a reasonable time, and at a reasonable distance from the insured person’s place of residence, based on professional medical judgment.

The right to equality

Eligibility is granted regardless of economic status, age, sex, or health condition.
Health funds are not permitted to refuse an application for membership.

What services are included in the Health Services Basket?

Some of the basket services are the responsibility of the health funds, and others are the responsibility of the Ministry of Health.

Basket services under the responsibility of the health funds include, among others:

Medical diagnosis, consultation, and treatment; surgeries and transplants; medications; hospitalization; medical devices and equipment; rehabilitation; child development tests; rehabilitation and mobility aids.

Basket services under the responsibility of the Ministry of Health include, among others:

Preventive medicine (vaccinations, school health services), nursing hospitalization, and more.

Receiving the rights included in the Health Services Basket

Under the National Health Insurance Law, every Israeli resident is required to belong to a health fund and pay health insurance contributions.

Registration with a health fund

Every resident is required to register with one of the health funds of their choice.
New immigrants and returning residents are entitled to a registration process with special guidelines.

These payments are collected through the National Insurance Institute (HaMosad Le'Bituach Leumi), according to income level. 

How can I know what I am entitled to under the Health Services Basket?

On the Ministry of Health website, you can view all entitlements defined under the Health Services Basket.
At the following link, you can find the Pharmaceuticals Database of the Pharmaceutical Division of the Ministry of Health and check, for each medication, whether it is included in the Health Services Basket.
Under the “Search Rights” on the Leumit website, you can view all entitlements provided, both as part of the Health Services Basket and through the supplementary insurance services – Leumit Silver and Gold.

Rights of populations with special status

On the Ministry of Health website, you can find information about the rights of populations with special status, such as children with special needs, recipients of income support benefits from the National Insurance Institute, older adults, patients with chronic or severe illnesses, people with disabilities, and/or victims of accidents and hostile acts.

Co-payment for Healthcare Services

Some services included in the Government Health Basket are provided at no cost, while others require a co-payment. This payment is intended to support additional funding for healthcare services beyond the public budget allocation, and it varies depending on the type of service, treatment, or medication required.

The level of the co-payment is determined by the Ministry of Health, with the approval of the Knesset Finance Committee, and is adjusted to the medical needs of the population.

It is important to note that discounts and exemptions are available for certain populations, including children, people with chronic illnesses, Holocaust survivors, and low-income individuals.
